Q & A – In order to pre-select properties that fit your needs, wants and ambitions, we need to ask a lot of questions. The answers you provide allow our realtors to search the thousands of properties available for sale in and around Marbella for those that might enchant you. We don’t want to waste your time by pointlessly driving you around to view properties that fall outside the parameters you supplied us with.
Offer – Once we’ve helped you find the property of your dreams, we will negotiate both price and conditions as per your instructions. Our knowledge of local customs and market conditions now comes into play and Lotus Properties will help you secure the best deal.
Securing the property – Once your offer has been accepted, the property needs to be secured, i.e. taken off the market. Usually, this is done by the buyer paying a reservation deposit. Also, at this time an agreement is drawn up stipulating the conditions of the transaction such as the date on which the deed or conveyance (escritura pública) is to be signed. Generally, both parties allow for around 30 days to prepare all the paperwork.
ID number – All non-Spanish buyers need a (tax) identification number in order to conduct any type of business in Spain. This number (NIE – Número de Identificación de Extranjeros) can be easily obtained from the local office of the National Police (Polícia Nacional). This number does not give a right to residence in Spain.
Residence permit – To acquire property in Spain, it is not necessary to have or apply for a residence permit. Nationals of EU member states do not need a permit in order to live in Spain. Non-EU citizens must apply for a residence visa at the Spanish embassy / consulate in their home country. Upon arrival in Spain, this visa may be used to obtain a residence permit.
Due diligence – Our lawyers will conduct a thorough title search (due diligence) to ensure that the property of your choice is unencumbered and free of any issues, legal or otherwise. Our lawyers will also advise you on any fiscal issues regarding your investment. They hate nasty surprises as much as you do.
Public notary – Both vendor and buyer, or their duly appointed legal representatives, must visit the offices of a public notary to sign the deed of conveyance. The public notary then certifies the deed as a registered public document which will then be inscribed at the Public Land Registry. This is the last step of the transaction and ensures that you are the legal owner of the property.
